A discussant is expected to play variations on the themes composed by the main speaker. Alternatively, he may, however, be like the pianist in a New Orleans jazz band who fills with a few notes the silences between two improvisations. I find it difficult to disagree with the descriptive/ analytical part of Ms Hughes’ paper, as well as with her references to the proposals made in the framework of the negotiations to reform the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU). Rather, I will try to fill the moments of silence in Ms Hughes’ report.
